Zynga apes Pokemon with suspiciously similar Montopia -Destructoid

I think Nintendo, Namco-Bandai and Atlus/Index Corp. could file a join lawsuit on this one. I'm not exactly cheering for EA on the EA vs. Zynga thing, but it amazes me that both they and the likes of Gameloft get away with what they do.

It's not the idea but the delivery. How closely "duplicated' the delivery is will be the opinion of a presiding judge. If it's too similar, then Zynga has infringed.

there are plenty of other franchises in Japan and abroad; frankly I don't see anything that makes this similar to pokemon other than that some designs are inevitably similar-- any company accused of infringing by nintendo could easily point at the pokemon fanbase whining that even new pokemon look like cheap ripoffs of older ones.

This is kind of my take on it. What's next, Pokemon suing Digimon or the folks who made Dragon Warrior Monsters? You don't get to file lawsuits against people just because they happen to make a game in the same genre as you.

(1) Nintendo hasn't sued Zynga.
(2) Article linked in OP is either an editorial or a blog post (opinion, not news)

My discussion centered around a potential case and how, if any, a claim that gets brought to the courts will be ruled on.

You're assuming Zynga is capable of making a game and not just duplicating one.

I'm amazed Natsume didn't go after them long ago, then again, they might not be big enough to.

Still, I'd rather play Harvest Moon and Rune Factory than Farmville. I think Harvest Moon actually has an anniversary edition on 3DS this fall (CE comes with a giant cow plushie). Riffing on The Sims was playing with fire, though, that's been around for over a decade and just as dangerous as going after Pokemon.

Farmville is a joke compared to HM or RF.

Though, Natsume hasn't really put how a HM game that I've just loved to tears since HM64. I'm still holding out for a PS3/360 game with online play. It'd be cool to actually see your friends' farms, or work on one together.
