    Why not? A cartridge is a form of storage, not unlike an SD card, a flash drive, a CD, or a hard drive. You don't pay anyone when you move data between different kinds of digital storage.

    I'm not saying Nintendo has to give me a Virtual Console version of a game I own. A Virtual Console purchase is not just the ROM, it's a ROM+emulator. Additional work was involved in getting it to work on the Wii. But I should be able to have the ROM file on my PC. And correct me if I'm wrong but emulators themselves are not illegal. Put two and two together, and I should be able to play the ROM on my PC provided I bought the game and obtained an emulator.

      Its Nintendo's software - they have every right to say what it gets played on, same as Sony and the PSOne games on PSN.

        What? They can get say that I don't have right to the source code and I don't have a right to modify it and profit off it, but I don't see how they can dictate what their code runs on. Do they also get a say on what controller I can use?

          Depends on how much you're worth (R4 retailers, for example) or how much damage you do (Geohotz), apparently. People tend to peursue legal action over piracy if they feel the investment in lawyers is worth it.

          Cases where the offender isn't worth the money spend on lawyers, however, there's really nothing that can be done and the matter is settled.

          Geohotz has not only thrown the gate wide open to piracy on PS3, hacking PSN and cheating in PSN games, he's posted a YouTube video calling Sony "fudgepackers" and dared them to use it in court. It casts him in a light of being unrepentant for the results of his actions.

          Is it worth it to Sony to string this one up? Quite possibly yes.

          We had a hacker in FFXI who was just as defiant, he would take his little crusade to other people's accounts, drop their relics and perform server transfers on their characters. He believed he was taking the fight to gilbuyers. Have we seen one of his caliber since? Not really.

          Of course, where that guy really went wrong was using other people's credit card information. Using someone else's credit card without consent to do a transaction is indeed identity theft. And then he posted about what he did, basically giving incriminating evidence.

          Geohots is more like a guy who knew how to lockpick a door and disarm security systems, well, except he showed everyone how to do it. I think that at the very least makes him an accomplice to a whole mess of violations.

                Somewhat related and steering us back on topic.

                There's now over 600 classic games on Japan's PSN- Destructoid

                Most of those are PSOne games, by the way, though some are Neo-Geo and PC Engine games as well. Compare this to the 120 or less NA and EU territories have gotten. NA territories got a small boost by just bringing some of the games over in Japanese since Japan has the NTSC thing in common, but the Japanese games they brought over were mostly just fighters or shooters since those don't lose much for you not knowing the language.

                  I absolutely loved xenogears. I remember seeing it in a playstation magazine and for months in the list of release dates it said tba until finally we were told it was not coming to the uk. My dad around the same time became a gamer and we modified our console when we found we could buy imported "not pirated/copied" games from a local pc repair store.
                  I loved that game so much such a fun battle system. It wasnt until recently i discovered the game had alot cut out of it. Which is a shame because for an rpg it's really good and draws you into their world.

                    Eh, this is the only point I'll disagree on you with. Unless they have updated it and changed stuff, I shouldn't have to pay for the same game again just because my physical copy is unusable for whatever reason (these things don't last forever)

                      The thing is it is legal to own a ROM (unless they changed that since I last checked) of a game you have already, and of course the emulators are legal as well.

                      Its why I dont have a problem with having Super Smash Bros or New Super Mario Bros. on my Arcade Emulator PC.

                      Infact I have ISO copies of all my Wii games, so I can run them off my HDD plugged into my Wii, so I do not wear out the disk drive or my games. (Wii and my PSP are the only two system I have hacked)

                        I was talking about systems where they couldn't possibly have known digital distribution was going to be a possibility - no one was even thinking about that stuff with the NES and SNES and there was no registry system in place back then.

                          Owning ROM's is always illegal even if you own the original cart. Each time you buy videogame software you buy one license to use that software, so if you download a ROM you still don't have the second license you would need to use it, hence illegal.

                          Back to Xenogears, I absolutely loved that game for most of the first disc. Then... (spoilers) unfortunately the second disc seemed so rushed and incomplete that it totally ruined the experience for me! Both discs considered I'd say the game is only ok at best, but if you ignore the second disc completely then the game is awesome. I actually think they should've just split the game into two games, to give them the proper time and funding to finish it off properly.
