I think anyone who breaks the NDA does so at their own risk, however, I don't see any reason why another tester would feel the need to play contract police for SE. You aren't going to receive any cookies and your actions aren't going to improve the game, so why ruin the fun for those who are anxious to see how the game is shaping up? SE doesn't give a rat's ass about you and kissing their collective ass isn't going to change that. Sure the contract says you're supposed to report leaks, but think about it, who do you benefit by following that point?
You break the rules you get banned, plain and simple.
Could I please see something offical where it states that "testers" will be "snitches" on each other?
And If there is something offical stating this, why would you ever agree to it?
2.4 Beta Tester's Obligations with Respect to Infringement of Company's Proprietary Rights
The Beta Tester shall promptly report to Company any infringement, attempted infringement, or other unauthorized use of any Products, Software, Documentation, or other materials owned or controlled, directly or indirectly, by Company, including the intellectual property rights therein, and will cooperate with Company in any efforts to enforce its rights with respect to such infringement, attempted infringement, or unauthorized use.

Glad were not to the beta yet.... crazy they did it like that, because most contract's don't leave things as obvious as that so *cough* open to interpretation. Weird.

I fail to see what interpretation it is open too.
Unfortunately the easiest way to properly test something of this size is to open it up to people you don't really have much control over and pretty much can't trust, as such you have to have the community assist you and police itself.
