I don't see this going anywhere, no more so than illegal immigration in the United States. The similarities are borderline hilarious.

If this lawsuit is successful, it would kill IGEs RMT in every game they associate with. They wouldn't be allowed to obtain payment for their transfers between the actual farmers and the end user purchasing the cash. It wouldn't stop RMT completely but it would crush it's orginizational ability. Which means when one of them gets banned it would end up hurting the farmers a lot more.

It's one guy sueing, trying to expand it to a class action suit. It's one guy whining about a company, this suit isn't going anywhere, he has no grounds to bring it.

          Re: IGE gets sued

          From the interview..
RN: You follow the money. Everything goes through the pipeline of Paypal and credit card companies. They have to go through legitimate institutions to further their conspiracy. So we can hit them in the pocketbook. We would take our injunction and enforce it against the payment companies so they can't do business. That's a real means to get them where it hurts. If we win, it's Armageddon for them.
And IGE will try to claim they aren't liable, that they are just facilitators. But as a former Federal prosecutor, I've handled this before. We had drug dealers say, "Hey, I never touched the drugs, so you can't touch me!" Although it's usually used by prosecutors in the criminal context, civil conspiracy is a recognized cause of action that lets us get past the shell game. IGE facilitates gold farming, and that's the conspiracy. And we think the evidence will prove to a jury that they're liable for it.
I like the angle they're taking here. They're treating IGE as if they were a crime syndicate, and that can open the door to criminal charges via the RICO Act. Very interesting stuff.

I can see the civil suit not going anywhere.. but the approach they're using is quite unconventional. See my above post.

EDIT: I forgot that the standard of proof in civil cases is MUCH lower than in criminal cases, so this could still have a chance at first. If/When it reaches an appeals court I wouldn't be surprised if the ruling went to the business interests. What a wonderful country we live in..

Interesting read. They only mention WoW and gold farming. I wonder if one of us should contact that lawyer Richard Newsome for sueing IGE in regards to Gil Farming in FFXI?

If he could make more money off of it, I'm sure he would go for it. I wouldn't want my name up there though, talk about embarassing.

Because WoW has 7-8 million whiners as opposed to say FFXI only having 500k whiners.

I think the player that originated the case is a WoW player, but the suit extends to IGE's RMT activity in all online games.

So question...if this guy wins the Class Action suit we can gain money from it becasue we play a effected game by IGE...right? I remember when there was a class action suit against Philip Morris when between the year of 1998 and 2005 and was seen by a doc for flu type symptoms and was diagnosed because of the smoking was given $3k or reimbursed for their Doc bills. Can't remember exact details but here's a link http://www.myfoxtwincities.com/myfox...Y&pageId=1.1.1

Philip morris pays millions to MN for smoking attributed illnesses...

-That link has nothing to do with what you said
-This suit will not go anywhere
-Class action suits result in a paltry sum for the 'winners' ($50 or less, usually a lot less) and large sums of money for the law firm. It's still no win.

Gil farming employs thousands upon thousands of Chinese workers. They're underpaid by a great margin. Just like illegal immigrants from Mexico!

Gil farming is "against the terms of service" yet is still very much commonplace, just like employment of illegal immigrants. Formally, everyone's "against it", but when it comes down to it, the reason gil farming exists is because it's a service people are willing to pay for, for convenience. Just like everyone wants the low prices they enjoy in Walmart... rules fly right out the door when convenience comes into play.

Again, this whole thing will go nowhere. There'll be a lot of talk, some exchange of money, and then everything will continue as before.

Yes that was closer but listed no settlement.

It is interesting in that this brings up the RICO laws that were hinted at earlier. RICO suits can only be brought by the governments, not citizens. If any one tried to, those charges would either be dropped or the entire case would be thrown out as it would have no basis. This is a citizen bringing up a baseless suit. WoW made no promise that players would be nice to him. He (should) have no dealings with IGE so they have made him no promise. He has no standing to bring a suit against anyone for making his game hostile because that comes with the territory. Only the people running MMO's have a standing against RMT operations. You couldn't, for instance, sue someone for stealing your neighbours car.

This suit is going nowhere. The person filing it probably just want's some attention and is trying to become some folk hero.
