Sounds like a law I heard about while I was living in the south called "fighting words". No idea if it was real or southern people being douches, but the gist of it was that if you try to incite a fight, you're at fault.

That seems to be like Arizona's "idiot driver" act. Basically stating that if you did something stupid while driving, like say tried to cross a flooded road after signs warned not to do it, then you'll be responsible to pay back the cost of saving your dumb ass.

Really though in quite a few places outside the US & Canada the law enforcement is wacky. Remember in Egypt out of absolutely no justifiable provocation the police tried to arrest me for something I didn't do, they however openly nudged that they'll ignore it if I paid them $400.00 on the spot. It was pretty crazy, I just got lucky that a few of the Egyptians I had befriended there helped me out of it. Basically they distracted the cops and told me to run.

It's pretty insane, and not the first time I've heard happen. My mother has stories of accounts in Egypt, Mexico, and Germany. My father has stories of Mexico, and Europe. It's pretty crazy, but then again I still find some of the US States have goofy laws.

I mean in Texas if someone invades your home you can't defend yourself without being arrested for doing so, Arizona though they allow you to defend yourself but you are safe only if you kill the invader in your home. If they get away then they can sue you and whatever other crazy crap. Officer once flat out told me if an invader tries to run away then do your best to catch him quickly and drag him back into your house before killing. He admits it's wacky but home invasion laws just are weird.

              EDIT:

Yeah, the "fighting words" deal seems to make sense of who I've seen get blamed for fights.

I hear that. Here in Kansas, if someone invades your home, you're legally obliged to run away, rather than protect yourself or your property. Not kidding. Last I heard a few days ago, there is legislation moving "fairly well" to change this, but still.

I can't find the story (keep getting fan fiction crap), but a year or two ago, a guy in Irving, TX (near Dallas) royally effed up 2 intruders with his katana. I don't remember him getting into too much trouble over it. Maybe you're right though and he got locked up. But it seems like he got away with it.

Usually they arrest you simply so they can try it as a self defense case, its just an oversight. Usually they do find it self defense and the person is set free fairly soon. I can't tell you that its a fact stated in law, but after living here for 20 years, that is the jist I seem to be getting. I'll get back to you all when my friend in training graduates into the force.

Would need more info from the article. Texas has a lot of restrictions, basically intended to keep people from doing anything of a vigilante type deal. Of course lot of it is tried on a case by case, so he did likely go before a jury. It's just that the jury found his actions to be appropriate and not extreme. Instances were that can happen would be if the guy is a Sword collector but he did not study kenjutsu or battojutsu then of course he wouldn't have the knowledge to properly control the damage he does.

If that is the case then he's lucky he didn't know those arts and then effed them up that bad. Like me, even though my trainer only ranks me as a Blue belt every other school I've gone to ranks me as a black belt. If someone were to fight me and I effed the hell out of them, then if the court talked to my instructor he'd probably state the damage I did was within the control of my belt level. If they talked to another instructor classing me as black belt, then they'd probably state that the damage was excessive and I could be in trouble for it.

Basically the courts are generally pro-life, so they will measure if the actions you took was the best you could control doing. If it was then you are usually safe, if it wasn't and you could of controlled the situation better then there could be a problem.

Actually, I think he killed one guy. It was all over the news.

But they were armed robbers, so I'm fairly sure it amounted to what Dieselboy was saying. If a trial followed, it sure wasn't ever mentioned again.

It sounds like the story about the guy who moved to New York from the south. One night he found an intruder in his sons room and told him to freeze. The burglar made a move to grab the fathers son, So he shot him an wounded him. The father went to jail and was facing legal issues cause the gun he fired wasn't registered in that state..

The law sometimes is a joke. I got charged with A&B because i grabbed a guy who was snooping around my very expensive tools i use for construction jobs in my garage. An threw him so hard he gashed his head open. Funny part is he knew nobody in my neighborhood, and didn't live anywhere close to my area.

You want joke, I was charged with battery... while I was in 5th grade... for bumping into another student. He didn't even bleed, just cried and got a bump on his head. Funniest part? High School youth court 'lawyer' didn't contact me at all until the day of the trial, and because he felt like being a lazy ass (see high school) forced me to plead guilty.

Wait no, that's not the funniest part, the funniest part is that the kid was my best friend. ffs.

Well as long as the guy didn't study kenjutsu or battojuttsu then killing the invader with the sword could be written off as accidental. He was only trying to defend himself, and didn't have the training to use the weapon effectively. So if someone died in the process, then it's just an oops.

That's the point I was making about the Arizona law. In Arizona if you threw him out and he injures himself or dies outside your house, then you will be held for it. However, since the guy invaded your house if he was to die in your house then you won't be held at fault. It's the little parts of the law that is just stupid as hell, I think. I mean Arizona's law basically is telling you that if someone invades your house he better leave unharmed or be dead in the house, no in-betweens.

I just find it stupid because if the guy is unarmed invading then I would want to throw his ass out, not kill him. Then if I don't and grab him to hard or he gets injured somehow then I'll be blamed. Damn you can't even disable and leave for the police to pick him up, if you do you'll likely end up going to jail with him. It's just the craziest thing ever.

Yeah we do have the stupidiest laws, Not to mention they vary from state to state. But what i find even worse then some laws are town ordinances. Which they only seem to inforce when they want to. I was fined for an improper driveway, The sad part is thats how it was when it passed all the village inspections. Now i just been fined for building a brick mailbox. Cause the ordinance says 4x4 post with 4 to 8 metal boxes each. Yet most of my neighbors have single boxes with houses on top, rubbermaid an metal. and im the one with the fines.. But the whip cream on top is they gave me the permit to build it in the first place..
