BBQ, if I decide to start jerking off in my car, that's still the same private place, right? Chances are nobody would see or notice, especially if it's dark out. Cop happens to walk by your car and see you though, that's a jailin'. What about my balcony? My neighbors wouldn't like that, not one bit. And that's not even injuring them, like cigarette smoke would!

There's such a thing called "Indecent Exposure". Somebody seeing you beating off can scar them for life. Aka: Mental Anguish. That's why that's Illegal.

Yes, but I don't understand what you mean by "criminalize harmful actions, not risky ones."

Are you saying that second hand smoke isn't harmful? Just risky? Or are you saying public masturbation isn't harmful, just risky? Both are harmful. But I think you should be able to do both in the comfort of your own home, as well as smoking. Just don't do it where people who want no affiliation with it can receive the harmful after-effects.

Thing is, not only are you being self-destructive (which, by all means, you have every right to in and of itself), you are also denying me my own right to life. And you do not have the right to dictate over my own life whether I live or die an early death to lung cancer.

No one makes it out alive and smoking is hardly the only common cause of death that's widespread. Hell if you want to bitch about smoking go ahead and bitch about every other poison our society pumps into the air, soil and water. Your right to a clean bill of health trumps everything right, so let's go ahead and shut down all those industries that put cancer inducing materials into our environment. No more cars, no more plastic products, no more large scale logging or quarrying, no more oil based fuels, no more electronics and circuit boards, no more meat products, and the list goes on.

So where does it end? The dividing line is not as clear as we'd all like to pretend it is. Your modern conveniences infringe on the health of others both here and in other nations.

So I'll ask again: who are you to say which rights take precedence?

The point was about not being able to go to a public place because of tons of harmful 2nd hand smoke. Non-smokers should be able to enjoy the same conveniences as smokers do and not at the risk of their health. Common sense and common courtesy has been tried and its failed so now its time to put down some rules since people can't seem to grasp the concept that their habit can make other people sick. If a smoker wants to take a risk with his health, I really don't care but don't put others in that category too because they do care.

I smoked and I smoked heavily for many years. I was always aware if there were others that didn't and didn't do it around them. (i.e. kids in the car, in a restaurant, etc.) Since most smokers could give a rats ass whether you don't want them blowing smoke over your table as you eat, thats why laws were made. It's unfortunate that we can't all be considerate of one another but thats just the way the ball bounces.
