That's because sane people have come to realize throughout history a centralized government program for anything never ends up doing any good. Dress it up with "basic human right" all you want, it will win points with bleeding hearts like yourself, but don't think for a second it makes you more morally sound than those that disagree with you.

Yeah that's why you guys are ranked right near the bottom for Health Care (despite having quality doctors and equipment) while the rest of the world pities you for being so wealthy while having a very high poverty rate. That's why our Banking system is #1 in the world and barely felt the recession at all.

It's not a fault of "Centralized Government" so much as it is the actions of a greedy, self-serving electorate.

My enjoyment is contingent upon being able to do so while on a walk, which necessarily takes place in public rather than the privacy of my own home. You have a right to a clean bill of health. For this to happen you need to not come in contact with my second-hand smoke.

See, this does not apply. First you are out of doors and if people do not like walking behind you or beside you while you smoke (since this is where the greatest of the smoke concentration would be), then they can cross the street and walk on the other side. They can also wait a minute or two and you will have moved on and, since you are outside, the danger dissipates very quickly.

When you apply this to indoor structures, everything changes because you are in an enclosed structure where it can accumulate and the potential for danger is everywhere. I've sat in the non-smoking section and in the middle of my meal left because the smoke does not stay in one area but drifts into non-smoking areas. You'd have to have air filtration like NASA has if you wanted to keep the smoke under control and thats not going to happen in your average restaurant.

edit: And it's a bit fallacious to insist that your rights are being infringed upon if you can't smoke somewhere. But it's also blowing the issue out of proportion to say that you can't smoke outside without infringing on someone else's space/heath/rights/whatever. You can smoke outside. Sometimes you can't do it outside of certain businesses, or in certain parts of outside, but that's usually because those areas have heavy foot traffic, and the smoke would bother others.

Get to the heart of the matter: smoking isn't a right in our society, therefore banning public smoking doesn't violate the ruleset you keep parroting at me.

Step back from the societal context for a moment though and suppose smoking was a right along with your health. How would you reconcile those two? Your ruleset falls apart because each right would infringe on the other. This forces one to take precedence over the other, and effectively violates the ruleset. What we have is a ruleset that does not work and only serves to conceal arbitrary designations behind a facade of mutual coexistence of that which is mutually exclusive.

Also, even in your hypothetical situation, the "right" to smoke and the right for health have already been reconciled: you are permitted to smoke in violation of your own health, but when you start screwing with the health of somebody else (whom you've never had the right to screw with in the first place), you're crossing the line.

The only exception is, like I said, yourself, who, not being "another," you technically do have every right to harm.
