    "A private server company, Scapegaming (aka Alyson Reeves), was ordered to pay Blizzard Entertainment over $88 million in damages after losing a lawsuit that was concluded last week. Scapegaming was operating unauthorized World of Warcraft servers and using a micropayment system to collect money from the servers' user base, which according to the lawsuit amounted to just over $3 million. $85 million of that settlement was for statutory damages, and surprisingly only $63,000 in attorney's fees."

    How the hell do STATUTORY damages get to be almost 30 TIMES the actual damages? How much "pain and suffering" or whatever can you really have over something like this?

    Since I don't want to get worked up so late, I won't read the entire thing... where exactly was this ruling? In California or elsewhere?

    Not that it matters to my point mind you.... it's almost as if nobody has ever heard of proportional response.

      Of course they have. That's not enough.

      But in all honestly, it's not that terrible of an idea with how fucked up the legal system is right now, in some cases. The assumption being that the target is also paying for all of the other people they're fucking over, who don't have the ability to pursue legal recourse.

        Ya don't even talk to me about the f'in legal system. I have had 2 cases (1 still active) and thinking "well I'm in the right here so nothing to worry about" is naive. First case I was broadsided by a SUV while on my motorcycle. I was stopped at a stop sign. The guy that drove it got out, looked at me, then drove off down the street, parked his vehicle at his house, and then walked back up to the scene. He was driving with a revoked license and had been drinking. I got a ticket and nothing happened to him. Second case is still pending but the jist is that I opened my door while paying attention to the dog and some nimbrod leaned a 6' box filled with wood against the door. It slid off and before I even realized it was there, it had hit me in the head, cut open my forehead, knocked me out, and gave me a concussion. Subsequently, I have a few blown discs in my neck and have regular migraines. My case is tanking because I had previous headaches that were related to high blood pressure. I'll be lucky if they give me enough to pay off the bills I've incurred so far but thats unlikely to happen.

        Yes, our legal system...where you think you are in the right but not if someone can twist the truth better than you.

            Yeah.... No.

            I rather LIKE the lawyer Allstate gave me after I rearended a lady and she sued for quite a bit of money for what the accident was.

            Day of the arbitration, and later the day of the trial, guess what she says? I caused her weight gain (but she was already at 250lbs before the accident FYI) I caused her gout (seriously, AND she was a nurse) I have prevented her to go hiking/camping/dancing each day as she was accustomed to, forced her to quit the job she loved, etc etc. Oh, and she wanted $50k, about I think $6,000-$8,000 or less where actual damages and medical bills.

            The kicker?

            I hit her stopped/mostly stopped car while going 18 MPH.

            The other kicker? The job she loved forced her to work 20+ hours of unpaid overtime a week, odd how that was not mentioned at the trial. I'm rather of the mind that she wanted a new job. At least I'd be looking for a new job if the one I had forced me to work that much unpaid overtime consistently each week.

            Now sure, it's bad I hit her and it's also true I caused her what they called soft tissue damage, but still, what she wanted was excessive.

            Actually no, at arbitration she wanted $38k, at trial they demanded $50k. She got $18k.

            Frankly I'm just glad it is over. It was an interesting experience, but damn I never want to go through that again, talk about stress.

              It seemed that the judge was old friends with the guy. The guy also had prior drunk driving tickets (of course he had a revoked license) and he had some property damage that he had not paid for from a previous one. (The guy was smart after he drove home and parked, he got out a beer and then walked up to the corner. A witness that saw him stop and get out and look at me also walked up to him and yelled at him and could smell the alcohol seeping out of him. But nothing he said or the 2 other people said helped at all.) That was all that was done, the judge told him to start making payments for past property damage since he had not yet. I got the ticket because I tried to see the traffic. I stopped at the line by the stop sign but there were cars parked illegally all the way up to the corner obstructing my view. I moved my bike up over the line so I could see oncoming traffic and then the guy that hit me cut the corner WAY too tight and broadsided my front end. I got a failure to yeild the right of way I believe...been a while since it happened so I could be wrong but I did get a damn ticket. You know what the funny thing is? Insurance companies usually side with the cops because they love jacking up your rates...except this time. The insurance company reviewed my accident after I complained to my insurance guy (he's a friend) and they sided with me. Isn't that a kick in the pants? lol

              As for my current case, I won't get what I need. I need enough money to have my spine fused in my neck (I don't want to do it but I may have to) or to take the two medications that help the headaches for the rest of my life. Either way, big bucks and its just not going to happen. They offered me 10k.
