Thing is, generally I'd agree with you-- people should be able to come to blows every now and then without facing jail time. But then, if you can get in one fight and have that be deemed 'ok', and another deemed criminal, you start to get into very murky water, legally speaking.

And therein lies the trick part. At what point does it stop being a small dispute and turns to assault?

Personally I'd leave it to a judgment call based on personal injury or possibly motivation? I mean, if no one got seriously hurt then it's no biggie. If said person was threatened and it was stopped before it got too ugly, that's another story. It's all too big of a grey area and I can easily see how lawmakers wouldn't want to touch this with a 50' pole.

I think in the end, the judge may say that they both need to grow up and throw it out. It's a waste of time and energy.

He has every right to make that call. Most of us would agree with him for doing so.

The police officer's job is to arrest offenders of the law. If they don't do that then they are not doing their job. What happens to them after that is up the court system.
