    US Doctor Richard Batista Wants Kidney Donated To Wife Back After She Cheats And Files For Divorce | World News | Sky News

    "Richard Batista from Long Island in New York, US, says he wants the organ back or £2.1m ($1.5m).

    The surgeon gave his wife Dawnell the kidney in 2001 after two previous failed transplants.

    Dr Batista told the New York Daily News there is "no value you can put on an organ when it saves someone's life. There is no greater feeling on this planet."

    He says he is only suing Dawnell to get her to act reasonably in the divorce case, claiming she is restricting access to their children, aged eight, 11 and 14.

    Their relationship had been suffering due to the strain of his wife's medical issues, said Dr Batista.

    "My first priority was to save her life," he said. "The second bonus was to turn the marriage around."

    But it did not work and four years later she filed for divorce.

    Arthur Caplan from the University of Pennsylvania's Centre for Bioethics said the likelihood of Dr Batista getting either his kidney or the money was "somewhere between impossible and completely impossible".

    Medical ethicist Robert Veatch from Georgetown University said it was illegal for an organ to be exchanged for anything of value.

    Organ donation is a gift which means you cannot legally get it back, he explained.

    "It's her kidney now and taking the kidney out would mean she would have to go on dialysis or it would kill her," Mr Veatch said.

    He insisted no reputable surgeon would perform such a procedure and no court could compel someone to undergo an operation.

I don't care if this woman slept with the entire U of M football team, this guy's idiocy tops her in spades. FYI, she's laughing her ass off at him because she knows there is not a damn thing he can do. He can't get money and he can't get back the kidney...he just ends up with egg on his face. I hope he loses a lot of patients from this too. I know I'd stop seeing him immediately.

    I work in a clinic ... yeah... doctors are a breed in and of themselves.

          He's just upset. I'm sure many of us would be feeling very hurt and angry in his position. His desire for his kidney is unreasonable, but his wife to cheat even after such a gigantic gift is despicable.

          Personally if I had been divorced by my wife who I had gave my kidney to (with the risks and life style changes that doing so accrues) and then she was restricting access to the children (which might have some reasonable but not mentioned reason) after first committing an infidelity, I would be flat out infuriated and desire that I could go back and change my decision as my kidney is now benefiting someone that has hurt me. I'm sure many of you would feel the same. Even removing the equation, how many of you would give a kidney to a stranger? Not very many. This is definitely a minus 1 situation.

          I don't know where the do no harm or such horrible spin against the doctor comes from, especially given his stated reason for doing so as it is more metaphorical than it is literal. Maybe you should be looking at the wrongs the cheating, previously dieing wife has been committing against her faithful loving husband. Hell, its even stated that the reasons their marriage has suffered is because of her previous ailing situation (which may be the truth or not) and then she goes up cheats, files for divorce and then tries to restrict his access to the kids. If anything it looks like he's defenseless as the bitch steamrolls him and he's just trying to grab at straws to gain a foothold in the divorce in particular when it comes to the custody of the kids.

            I'd be pissed to if I practically saved my wifes life, and she tried to keep me from seeing my children. Then again we don't know what kind of person/father he is normally, but this is still hilarious.

              I look at it like this. I've been down the divorce road. My husband and I nearly divorced....so near that all we had to do was sign the papers. I know what its like to be cheated on and feel bitter. While I threatened things along the way, I knew what was reasonable and what was not. What I knew I could get away with I used as barter but the unreasonable stuff I did in anger but didn't take it any farther. This guy is a doctor and he knows that he can't get away with this so he knows its unreasonable. Yet, he takes it that one extra step and goes through legal action......thats being a jackass.

              As far as keeping the kids from him, thats what the law is for. Unless he's severely abused them (physically, sexually, or emotionally), there is no way she can keep his children from him. My daughter went through a very messy situation with her son's father and he was neglecting the child but still has 50% custody. Proof is the name of the game and that can be very difficult to do sometimes.

              Would I give a kidney to a stranger? Yes, I would but this wasn't a stranger. If my husband needed a kidney I'd push myself to the front of the line to be tested. He did the right thing but now he's doing the wrong thing. It will never go through to have the kidney taken back. If it did, it would ruin the entrie transplant program which would kill millions of people.....including me.

                You miss that it seems that even he understands its something unreasonable. All it is meant to do is sober her up.

                  How would this sober her up? She's probably laughing her ass off because any sane person knows that its absolutely impossible. In fact, it will probably have the opposite effect. He did this for publicity to embarass her (when actually he should be) and she'll get ticked off about it and go even farther to ostracize him from his children.

                    You know, it doesn't matter what the wife is doing legally to him during the divorce. Divorce is a messy business, and people trade barbs and do vindictive things. This, however, flys past Vindictiveland and lands right in the middle of spiteful bastardland. Think of it from the children's POV. This is daddy basically saying "I wish I didn't save your mommy's life". When a father is capable of saying that, then I'm all with the wife, he deserves to have his access to his children limited.

                      TGM, I've always respected everything about you. And I still do. But you sound like you're saying "it doesn't matter what she does, she's better than him."

                      If she wants to use the law system to cut him off from the best thing their relationship brought them (their kids), he can do obnoxious law tricks to make her stop. It doesn't matter if it'll succeed. She fucking brought this on herself -- on both of them.

                          Althought getting an organ back, or the amount of money he's requesting back is completely impossible, I do not agree with the wife cutting him out of the children's lives like that. After him saving her life (although he pulled a dick move with the whole wanting his organ back deal) the least she could do, even after a divorce, is to let him see his kids.

                            I don't understand this train of thought. Doing a good deed for someone entitles them to reimbursement for said deed? That is ridiculous. Giving a kidney (or returning a lost purse or helping someone carry something heavy) is not something you can demand payment for. Yes, it would be nice of the person to do something in return, but you shouldn't expect it.

                            Also, giving someone your kidney does not make you a good father. We have no idea what type of father he is, and honestly, the job of a doctor puts considerable strain on even the best family. The hours are long, and emergencies can pull them in to work at any time of any day. It is hard to live with when the doctor in question is a saint.

                              Correct me if I'm wrong, but where in the article did it say she cheated on him?

                              I would be pissed too if that were me, but he IS being pretty unreasonable. Even if she says hes doing it just to get her to be more reasonable, how can he expect her to act that way if HE'S also being unreasonable?? Wierd people, i swear -.-
