    Judge: Learn English or Go to Jail

    "A judge known for creative sentencing has ordered three Spanish-speaking men to learn English or go to jail.
    The men, who faced prison for criminal conspiracy to commit robbery, can remain on parole if they learn to read and write English, earn their GEDs and get full-time jobs, Luzerne County Judge Peter Paul Olszewski Jr. said.
    The men, Luis Reyes, Ricardo Dominguez and Rafael Guzman-Mateo, plus a fourth defendant, Kelvin Reyes-Rosario, all needed translators when they pleaded guilty Tuesday.
    "Do you think we are going to supply you with a translator all of your life?" the judge asked them.
    The four, ranging in age from 17 to 22, were in a group that police said accosted two men on a street in May. The two said they were asked if they had marijuana, told to empty their pockets, struck on the head, threatened with a gun and told to stay off the block.
    Attorneys for the men said they were studying the legality of the ruling and had not decided whether to appeal. One of the attorneys, Ferris Webby, suggested that the ruling was good for his client, Guzman-Mateo.
    "My client is happy," Webby said. "I think it's going to help him."
    The judge sentenced the four men to jail terms of four to 24 months. But he gave the three men, who already had served at least four months, immediate parole. Reyes-Rosario remains imprisoned on an unrelated drug charge.
    Olszewski ordered the three to return with their parole officers in a year and take an English test. "If they don't pass, they're going in for the 24 [months]," he said.
    Olszewski is known for outside-the-box sentencing.
    He has ordered young defendants who are school dropouts to finish school. He often orders defendants to get full-time employment. But he also has his staff coordinate with an employment agency to help them find the jobs."


    I can see where the judge has a very good point.

    Most misleading headline I've seen in months.

    This isn't about forcing something to learn a language, it's about telling them to get skills and an education so they can contribute to society instead of surviving off criminal actions. It's also an alternative to jail time, the jail time is not there because they would deny learning the language.

      The jail time is there if they deny or not pass the test. As for the topic being misleading, it's not. If they didn't learn english and pass they go to jail.

        No, the jail time is there because they fucking mugged people.

        Becoming a functioning member of society (likely with plenty of government aid to get there) is being offered as an alternative to being sent to jail. Jail is the default here. Not some horrible punishment because they won't learn a language.

          So then they can mug people in English! Who can understand all that spanish anyway. If I was going to be mugged, I would want to understand what my muggers were saying!

              Regardless, the ultimatum of learn english or go to jail is still in effect. They weren't just pulled off the streets and forced to agree to these terms, true. But they were still given that exact choice. If they succeed in their attempts to gain an education and become functioning members of society they will escape jail time. But if they fail to do so, and specifically fail that English test, then they will return to jail.

              This is what the system needs more of imo. Just locking people up, especially stupid 'kids' like this, just makes things worse.

                If I wanted to mug someone and get away with just parole... all I have to do is just... not speak english? Oh. And go to school. Wait... and... get a job? Suddenly, this isn't sounding so good. Honestly - the ultimatum doesn't depend on their speaking english as much as it does their improving themselves, contributing to society.

                Also: I think what this judge is doing is great for these individuals. Education is so terribly important, and filling the prisons will get no one nowhere. That said; he's making a precedent here. I can see activist groups for other specific ethnicities becoming angry that they aren't being given such opportunities for self-improvement vs. prison time.

                One thing I think that is important is to sometimes "throw the book" at 'em. Making an example of folks can deter criminals, just as well as 'educating' them. Maybe, in making an example of their peers - we scare them into educating themselves? Eh, it all depends on the situation anyways... so that's a moot point.

                I like the judgement, and I applaud the judge for being... creative here... but I'd rather not see this become the status quo. Educated Criminals become people like Hannibal Lecter, right? Or that guy from Fracture? What is up with Anthony Hopkins and typecasting anyhow?

                  Gotta admit, if only court judges like this were more common we'd might have less problems in society than we do now.

                    Not some horrible punishment because they won't learn a language.
                    Since the only thing these 3 can think of to come up with money is to mug someone I'm pretty sure learning english, getting a full time job and passing the english test is horrible for them. I think learning a language, getting a FT job and passing the test will be harder than just wasting away in jail. Its alot to ask of them but it will give them much reward legitimatly unless they start stealling office supplies...

                          I think this is great. Rather than clog our jails with even more people who will become rehabilitated in the time they're incarcerated, this judge is giving them a chance to better themselves. This just might be the push these guys need to make something of themselves.

                          Then again, if they can't shape up then they'll get what they deserve.
