  • This month's incredibly stupid business move

Message to Daniel_K - Sound Blaster - Creative Labs

I mean, damn, that's a pretty stupid use of the IP excuse.

You kind of have to be stupid about IP, because of how the laws surrounding it work.

Woow. Incredibly stupid is almost an understatement here.

Sure, the guy shouldn't have accepted money for what is essentially not his, but at the same time, should actually be paid by CL for all the work he did FOR them. Apparently they're too lazy or stupid to make their own products work correctly on Vista... Why shoot down the guy who's doing it for free?

The thing is, they aren't shooting him down because they want to, they're doing it because the have to. Now, the smart thing to do would be to take him under their umbrella and compensate him for the work he has done, or start doing what he is doing themselves. So in that sense, yeah, pretty stupid.

          You're off today.

Also, not really. Plenty of companies let stuff like this slide, and with no negative impact on their properties. Plus, they're a hardware company. They aren't going to face a huge loss if people mess around and redistribute their software; really, they can only gain. This move has lost them much more than that ever would have.

            Yes, I am off today.

I'm not going to have a "Uh huh," "nuh uh" discussion with you, Feba. You win.

They claimed the guy was asking for monetary compensation for modifying and redistributing their software. I think that's a legitimate concern.

It's odd that they wont offer support for Vista, but that's business. Perhaps there's a strategy behind it that's undermined by his actions.

Perhaps if he had been asking for payment. But he was asking for donations. Two very different things.

Not when your product claims to support Vista. That's called "fraud".

It's called forced obsolescence, and it's extremely unethical at best.

I'll put $20 down that we'll have another VT just because no one is agreeing with him.

OP: Its bad buisness for CL to go after him.

It's spectacularly bad PR in any case ... they are just asking for a lot of egg on their faces.

Fact of the matter is, Daniel_K wasn't asking for payment and selling it comercially, which wouldve been an infringement of the Fair Use Act. He was asking for donations. Which means that he wasn't technically selling the software, he was just modifying it and distributing it to others.(For free) (He has great software programming knowledge. If I had a creative card I would download it.)

Creative saying that their software when it wasn't compatible with Windows Vista (Is anything really? ) is technically also a form of Fraud.

I personally consider Creative to have bad business practices and customer service in the first place. But thats beside the point.

As long as he states that he isn't affiliated with Creative, he could get off scot free.
