Well that's just it though, he needs to be able to recover all of the evidence. If he can, then he has a case for the reasons you all stated. Not sure how he can prove the shirt was the intended item though.

Tracking Information, Order Confirmation, Proof of Purchase and Payment, Receipt and Transaction Information and that the courier will be able to confirm that the package wasn't received isn't enough to prove he bought the item but didn't get it?

frankly, I doubt the police will be of much use. This sounds more like a civil court sort of situation.

Best thing to do would be to talk to a lawyer; of course if you have to actually hire one, you're going to be spending a ton of money (unless your jurisdiction allows you to have your legal fees included in the judgment.) I think you may be able to get a lawyer to write a letter at little or no cost, threatening to sue, (or simply inform them yourself of your intention to sue), and most people will generally give in to avoid the hassle of a lawsuit.

I would try to get evidence beyond "I saw them in the shirt" that they do actually have the shirt though; a photo of them in the shirt is good, if you can get them to admit again that the shirt arrived on their doorstep and record it, better. (do check first though if you need mutual permission to record conversations. Alternatively, having a trustworthy member of the community there would also be good)

Of course in all practical ways, it's not worth your time, unless the principle is super important to you

In the UK :- Under the Postal Services Act 2000, it is an offence intentionally to open or delay a postal packet. Interfering with someone else’s package may also constitute the tort of conversion or trespass to goods.

And the punishment for commiting said offense in the UK is a "stern talking to."

I hate getting randomly weepy for no reason. It hasn't happened in a while, but every once in a while (and it usually accompanies my cycle) I will just start crying at something moderately sad and then won't be able to stop for hours. I was literally crying like a toddler last night.

I'll be honest, I can't believe people still watch that show. Then again, it shouldn't surprise me because people still watch Honey Boo Boo for some unfathomable reason, and if given the choice between the two, I'd surely pick American Idol any day of the week. I just personally have felt the quality of the show has gone way down.

But yeah, I can (and do) tear up at everything, but sitting on my couch hugging a pillow and sobbing like a three year old - not exactly a finer point in my life.

My downstairs neighbor and I are engaged in an epic struggle where both of us only stand to lose. She is blasting her heater to unbearable levels, roasting me in my room. In kind, I open my window and allow the freezing cold air in, no doubt falling down to her floor.

Met my ex today to help her learn some things. Used her laptop, and a bluetooth mouse.

She had the scroll wheel inverted.
