You know, I was going to complain about Destructoid's new upvote/downvote system, but now I don't know. I wasn't constantly downvoted by others or anything, usually upvoted or neutral, except that there was this one guy going around downvoting everyone at least once per news post. Now his name is grayed out in yesterday's older posts and his avatar is gone.

I'm new to the Disqus comment system, so I'm not entirely sure what it means, but I'd like to believe he somehow fell into a trap where he could ban himself.

I don't think I even need to make a comment on why this pisses me off. Human's sicken me, I fail to see the logic in beating a child that loves you uncondionally to the point of where they are no longer breathing. It's that type of shit that seperates normal people from monsters such as this woman. Now my taxes are going to be paying for her to sit in prison eating luxurious meals and being "counseled". Fuck her, give her the chair.

You know the sad thing is, it actually costs more money to execute someone than to lock them away for life.

So 99 years to rot away or an easy and painless exit where you can no longer be punished?

Things like the chair are just for baying mobs to get their pound of flesh and is hardly justice at all. How can someone be punished if they are no longer there to be punished?

                  That's not punishment, that's revenge.

And no matter how much you torture a convict, whatever they did will never be undone. It would be much more practical to rid the world from their presence and move on. But for that you'd need a real justice system that didn't get so many innocents executed.

Problem is many times convicted criminals' case is so botched they can get many appeals going on for their cases and take decades to execute, and if the case is that flimsy to begin with it completely negates the benefits of executions. So either they execute people fast or don't execute them at all.

And on the other side of the coin if executions were banned and people got forced labor instead... well all the flooded for-profit prisons in the US show that ends up becoming slavery instead of justice. Because both the Prison worker unions and the Corporations start pushing for stupid laws and demanding 90% occupation on prisons like they are some sort of Slavery resort. And that's not even counting how much they charge State Governments for this prison privatization (and all paid for with Tax dollars from the people they are incarcerating, woo hoo.)

                  So... yeah...

Yeah, despite my pointing out there are cheap ways to dispose of human waste, having lost a relative to murder I can say there's nothing short of that person having to live with it each day for the rest of their lives that is going to appease me. I want that guilt on their conscience forever, hopefully because it will change their heart in time or and if not that, at least destroy their minds. Killing them does them a favor they are not owed.

Sadly, my grandfather's murderer got a light sentence in a women's prison due to emotional instability. All I can say say is I hope she changed or, at the very least, was stopped from pulling the trigger on herself like she pulled it on him five times.

I've never understood all the "insanity" garbage.

It doesn't matter if a person was delusional, or on drugs, or going through some episode. In the end they did what they did and should be sentenced as such. If anything it should add more time and tests to their sentence to make sure they can actually be released.

It was long ago. Not too big of a deal now, but it did kind of damage my faith in the judicial system somewhat.

Shockingly enough, you had some to begin with.

My peeve is that for the second week in a row now, my phone has given me the "I'm dying" bleep in the middle of my sleep for my 6AM shift. As if I didn't have enough trouble adjusting to mornings already. At least this time it was almost time for me to wake up.

But that brings me to another peeve, why do smartphone batteries die so damn fast? My previous phone would go three days before I needed to charge it. I have to charge this fucker for at least a couple hours every day.

I'm not sure what it's like in the US or Mexican system but in the UK, there is actually a distinction between "genuinely insane" and just delusional or going through some episode. And generally using insanity as a defence means you're never coming out of that institution until the doctors are 100% sure that you are sane.

Section 2 of the Homicide Act 1957 states: " Where a person kills or is party to a killing of another, he shall not be convicted of murder if he was suffering from such abnormality of mind (whether arising from a condition of arrested or retarded development of mind or any inherent causes or induced by disease or injury) as substantially impaired his mental responsibility for his acts and omissions in doing or being a party to the killing."

Basically it means that in England it is only a partial defence and you can please "Not Guilty due to Diminished Responsibility" in England and Wales (Scotland and Northern Ireland have slight different rulings on it) which basically doesn't get you off but gets the offence changed to Voluntary Manslaughter.

There's also various different rulings in Common Law. Because the UK doesn't have a written Constitution, Case Law, past precedent and essentially the legal equivalent of arguing with your DM so see if the rules are intended to be used/interpreted in that way, plays a big part in our judicial system. Judges tend to direct Juries to consider the following when dealing with drink/drugs and diminished responsibility:

                              1. Would the defendant have killed as he did if he had not been drunk?
                                If Yes
                              2. Was he suffering from diminished responsibility when he did so?

There's also a bunch of different ruling s precedents on if addiction to substances can be grounds for it and does ask if the defendant's dependency really affects their mind so much, then has it had some effect on their state of mind?

So I'm not sure what it's like over the pond but here we do have it pretty sewed up: if you kill someone and try to plead insanity then you had better be insane and prepared to potentially spend the rest of your life with the men in white coats. Also if you are in a state of mind that would allow a partial defence of diminished responsibility, then you're still going down for Voluntary Manslaughter.

Also duress can't be used as a defence to murder in England. So basically say someone here takes one of your family and threatens to kill them of you don't kill someone else, or if someone basically comes up to you, puts a gun to your head and says "I will kill you if you don't kill this guy" the law here expects you to say "no". It doesn't even bother trying to debate the morality of it all (which is one huge mess of grey). The courts simply do not accept a defence of duress when harm done by the defendant is greater than the court's perception of the harm threatened.
