I was eatting a strawberry yesterday and my back 2 teeth bit into it and took out a piece of my cheek too =( Also I have them extra teeth at the back (forgot name/having a dumb moment) Growing through too, so thats making me bite my cheek too =(

Anywho: Back to what I was going to post before my heart jumped into my throat.

So as many of you know by now, my wife and I are in the process of buying a house. 3 months ago we settled on a price and got it accepted. Since then, we've gone through hell and back with a lot of different little things going wrong. I won't get into the details of those, but suffice to say that by this past Friday we had made it to the "what the fuck else could go wrong?" point.

We were all set to close on the house TODAY. In fact, I was supposed to have been signing papers right now and getting a glee-filled cramp in my wrist from years of not holding a pen and resorting only to a keyboard. Instead, I picked up a shift here at work and I'm back without a house. It was our decision to walk away from it, but we didn't do so by choice. We walked because our hand was forced.

When we originally had our offer accepted, they ran my credit to check to see if it was high enough for the loan I needed to take out. It was... and then some. In fact I was 40 points above where I needed to be. That made me happy.

As is customary for a closing, they ran my credit again yesterday to be sure that I hadn't royally fucked up in the past 3 months. The following is what happened to me over the past 30 hours:

I got a call from our loan guy informing me that my credit had dropped by 60 points as a result of an delinquent Bank of America Credit Card that had gone to collections. The amount due on it was $900.00. Funny thing is, I haven't banked with BoA since 2006. Not only that... but I never opened a credit card with them... ever. So of course I had to investigate this further.

I called up BoA and was given the run-around from department to department to find out where this originated. Turns out that in 2006 I was auto-enrolled in an overdraft protection program with BoA "in my best interest". First of all, their overdraft protection program opens a credit account under your name and forces any overdrafts from your checking to be placed into the credit account instead of you incurring a $37 overdraft fee. It sounds good I guess but I never asked for it.

So... apparently when I close out my account in 2006, I never closed out the credit account that was linked with it... because I was't aware it existed. After all... nobody told me. So 6 years go by and suddenly I find out that a $20 overdraft into that credit account has been defaulted and passed around through 3 collection agencies until yesterday when it suddenly appeared on my credit history. My obvious next question was "Why the fuck did nobody ever contact me in the past 6 years to tell me I owed money to them?!?". Since closing my account, I have not once received a letter, phone call or email stating that I owed money to BoA or any of the collection agencies that my file has been through.

Due to the 60 point credit drop that had been reported to all 3 Credit bureaus, I am now 20 points under where my credit needs to be to get the loan for my house. I am officially furious.

So I take the next logical step and consult my lawyer to find out what can be done about it. Obviously they can't be allowed to let me delinquent account rack up overcharge and late fees without at least telling me it was there... not legally anyway. There must be something I can do to get it reversed immediately. After-all... they bottomed out my credit in a day.

As it turns out, the reason that my credit dropped was because the Date of Last Action on my account was previously set to 2006 when I closed the account. Thanks to this new company who updated my file, it was now boosted to last month... and racking up all the credit penalties associated with a 6 year old debt of $900.

Here's the thing though. According to US Law, Section 623... subsection A... section 5 of the Fair Credit Reporting Act (FCRA):

A person who furnishes information to a consumer reporting
agency regarding a delinquent account being placed for collection, charged
to profit or loss, or subjected to any similar action shall, not later than 90
days after furnishing the information, notify the agency of the date of
delinquency on the account, which shall be the month and year of the
commencement of the delinquency on the account that immediately
preceded the action.

In otherwords... they illegally changed my Date of Last Activity from 2006 to 2012. This resulted in the drop in my credit that would otherwise be well above the credit needed for my home loan.

So. With this legal information in hand, I called the company and asked to speak to their supervisor and discuss the matter with them and not a mere agent. Due to Massachusetts State law... if I were to even so much as begin negotiations for a settlement with them at this time, I would void and possible case I have against them, so I simply asked the guy "Hypothetically" that if someone... not myself specifically were to come to a settlement arrangement for the debt owed, could that person hypothetically negotiate to have their negative credit history on the account expunged immediately? My answer was an adamant no. So I regrettably informed him that he left me no choice but to pursue the case in court.

This morning my wife and I discussed the matter among ourselves and came to the conclusion that the seller of the house would likely not wait for us to finish battling in court to sell the house to us. So with a heavy sigh we called our lawyer and backed out of the deal. We lost our deposit, inspection and insurance down payment by doing so. Unrecoverable.

I then mustered my depressed-ass to the car and got psyched up on my way to the local courthouse. There, I filed a small claims suit against the parent company of the collections agency to the tune of... well lots. Several times the amount I supposedly owe. My reasoning was their blatant violation of the FCRA and the subsequent losses and damage I suffered as a result of their adjustment of my Date of Last Activity.

My court date is set and I've faxed the hard copy of the suit to their offices in South Carolina as well as a second copy to my Lawyer along with a recorded copy of all phone conversations I've had with their "customer service" and "management". God bless you Skype.

Considering it will cost the company more than the $900.00 they claim I owe them to hire a lawyer and fly him up here to dispute the suit, I'm currently waiting for them to call me back begging me to strike a deal with them on the matter. If not, I'm in for a court battle in small claims to squash them like bugs.

TLDR Version: Had to walk away from the purchase of my new house because BoA fucked me over by never telling me I had a credit account that was in default for 6... fucking... years. What else is new?
