Yes, you use the headset. You can talk one on one with other 360 users who have the headset. You cannot randomly talk to just anyone.

It works like XBox live. Basically get a headset and talk to people, should be able to find one at bestbuy. If you were playing on PC, would have to purchase Ventrillo or Teamspeak.

POL TOS states that you must be 13 years of age to use POL services, including games. Read as, unless you were born before <this date> 1993 you can't agree to TOS, thus you can't legally play the game.

Erm... Just in case you didn't know this, in order to communicate with anyone who's not on Xbox Live with a headset (PS2 users, PC users, etc.), you'll want to get a keyboard. There's a software keyboard you can use with controller, but it's really too slow to be of any use in most situations.
